Droit de suite: Resale Royalties and the Visual Arts

Droit de Suite (The Right to Follow) is a royalty payable to a qualifying artist or the artist's heirs each time a work is re-sold during the artist's lifetime and during the 70 years following the artist's death. This protocol originated in France in 1920 and was adopted by all other Western European countries. In 2006 it became effective in England, initially applying only to the works of living artists, and will soon be extended to apply to an artist's work after his death. There currently exists a momentum to apply these regulations throughout the United States. The Droit de Suite in the U.S. currently exists only in California.

What are the benefits of the droit to young, mid-career, and established artists? What will be the economic effects on the art market in the U.S. when and if the droit is instituted here? Will this represent a new cultural perspective regarding artists rights?
