Federal health care fraud and abuse enforcement is currently a high priority for prosecutors, regulators, and elected officials, and is predicted to intensify in the next Administration and session of Congress. One area of great focus, both of government enforcers and private plaintiffs, is the alleged unlawful promotion of health care products’ “off-label” uses. Unprecedented activity in this area, mostly under the False Claims Act, has led to a number of key litigation developments and settlements in 2008.

Two experienced health care fraud practitioners will assess these recent settlements and the enforcement environment at a Washington Legal Foundation (WLF) Web Seminar program. The speakers have held key positions at FDA and HHS’s Office of Inspector General, two federal agencies with significant involvement in off-label “promotion” matters.
