In 2006, the Federal Trade Commission took Guidance Software, Nations Title Agency, Xanga.com, Cardsystems, and ChoicePoint to task for their lax information security. http://www.cio.com/article/102709 As the lawsuits mount against TJ Maxx and Marshalls we find that compliance is more of an interpretive art than an empirical science. Discussion Leaders: Attorneys Scott Crooker and John A. Menchaca II (both in Winstead's Austin office) will lead the discussion of how to stay off the naughty list and out of the news. Failure to access vulnerability to known Web-based attacks, detecting unauthorized access to consumers’ credit card information, failure to use strong passwords, and failure to conduct ­security investigations are just some of the issues that the FTC has issue with. John and Scott will facilitate the group discussion of navigating these IT mine fields.

Scott Crocker, a member of Winstead's Litigation Section and Intellectual Property Litigation and Biotechnology Practice Groups, is actively involved in the representation of clients in all aspects of litigation in both state and federal court. Scott has assisted clients in numerous areas including complex business and intellectual property litigation, class action litigation and mass tort litigation. Scott has also used his background as the former Webmaster of the Winstead Web site to assist clients in disputes centering on Internet issues. Before becoming a lawyer, Scott worked as a research scientist at a biotech company, focusing on FDA compliance/approval issues.

John Menchaca's primary areas of practice are securities and corporate finance, with an emphasis on venture capital and private equity transactions, mergers and acquisitions, and general corporate matters. He has extensive experience representing venture capital and other private equity firms, emerging companies and entrepreneurs in connection with equity and debt financings, mergers and acquisitions, public and private securities offerings, joint venture transactions, recapitalizations and general corporate law matters. His experience has been across a wide range of industries, including software, hardware, information technology services, manufacturing, retail and other areas.
