Collaborative standard setting plays an important role in the modern economy and the IP marketplace. In areas such as information and communications technology the usefulness of complex products and services often depends on the interoperability of software, components, and products of multiple firms. To enhance the value of these complex products, firms frequently participate in standard-setting organizations to set technological standards for use in designing interoperable products or services. The three distinguished speakers will explore IP and antitrust legal issues surrounding the collaborative standard setting. Mr. Patrick Roach of the FTC will discuss the collaborative standard setting from a government perspective, as well as provide an overview of the FTC's policy project examining the legal and policy issues surrounding the problem of potential patent "hold-up"-when patented technologies are included in collaborative standards. Professor Michael Jacobs of DePaul College of Law will discuss the collaborative standard setting from an academic perspective, as well as provide a general overview of recent issues in IP and antitrust law. Dr. Claudia Tapia Garcia of Research In Motion Ltd.will discuss the collaborative standard setting from an industry perspective, as well as provide insights to the European collaborative standard setting.
