Opportunities and Challenges for Partnering and doing Business in China and other Secondary Emerging Markets

Today's tech ventures increasingly look to emerging markets for a sustained growth strategy, paralleling their focus on the more developed Western markets such as the US and Europe. In that regard, many believe that among the BRIC countries, China presents great opportunities. Excess liquidity in recent years makes China an alternative source for capital as well, in addition to being a source for cost-effective R&D services and manufacturing. Of course, China has become a vibrant market itself for many sectors-from high-end consumer goods to value-added services-and that alone is highly appealing in the face of economic troubles around the world.

How best to navigate potential opportunities in China?
How best to protect and control intellectual property rights for operations in China?
What are some of the precautions to consider in marketing and business dealings so as not to run afoul of the FCPA?
What are the current developments in the treatment of VIEs?

This panel is designed to share expert knowledge on current issues relating to the emerging markets, particularly China. As is relevant, the panel plans to touch on other secondary east Asian markets such as Vietnam as well. The panel will discuss the opportunities and challenges in leveraging emerging markets, and offer strategic advice with respect to IP protection and enforcement, FCPA compliance, and smart deployment of operating structures considering the use of WOFE, JV, VIEs and more.
