“Cloud Computing - Cutting through the Legal and Policy Fog of the Next Big Thing”

While some say cloud computing is over-hyped and others try to dismiss it is just a new name on an old package, it's indisputable that more and more data is moving off local servers into the cloud of third party data centers. Especially in tight times, cloud computing offers benefits of flexibility, timeliness, cost-effectiveness and security.

Yet, in a special report last fall that otherwise heralded the promise of cloud computing, The Economist warned: “What might stop the cloud from growing ever thicker (is) regulation and worries about the safety of both personal and corporate data.”

Most users of cloud computing services, and even some entrepreneurs looking to ride the wave, are unaware of the legal and policy issues associated with cloud computing. In fact, cloud computing depends on a framework of policy rules -- on issues ranging from privacy to security to law enforcement access to IP protection to liability for inappropriate content to transborder issues. Most of these rules were not even designed for cloud computing, but they govern the cloud nonetheless.
Now, with nearly 70% of Web-connected Americans using some cloud service, there is interest in adapting laws for new realities. This could either bolster or undermine the stability and attractiveness of the cloud computing model. Anyone interested in the future of the Internet should be aware of how these policy issues might affect their business.

In the second of a series of solution-oriented policy forums, TRUSTe and the Center for Democracy and Technology bring you the insights of some of the people shaping the policy and business environment for cloud computing.
