Regardless of the old saying, words can hurt you-especially if they've been preserved electronically. California's new electronic discovery law brings good news for employers in the sense you may now use your employees' captured comments and mistakes to defend against lawsuits. The same, however, holds true for you- your own comments can be preserved and used against you.

Mr. Caples is Of Counsel to the firm Fitzgerald Abbott & Beardsley LLP in Oakland and is a member of its Labor & Employment Practice Group. He is a trained mediator and focuses his practice on providing preventative advice and counseling for clients as well as wrongful termination and discrimination litigation.
