Judge Catterson wrote a concurring opinion in the Appellate Division (1st Department) ruling against the community, which started with this condemnaton of both the behavior of the Empire State Development Corporation (empowered by the UDC Act) and Forest City Ratner:

Because I believe that the New York Urban Development Corporation Act…is ultimately being used as a tool of the developer to displace and destroy neighborhoods that are "underutilized," I write separately...
